UD-120 Verification by Landlord Regarding Rental Assistance
What is the new UD-120 form required in unlawful detainers in California?
The UD-120 form, or in other words the verification by landlord regarding rental assistance form, is a new form required to be submitted, under penalty of perjury, by a landlord before a judgment can be awarded to the landlord in an unlawful detainer case due to nonpayment of rent. In other words, this single page form must be filled out, signed and submitted by the landlord before he can win his eviction case due to nonpayment of rent.
The UD-120 form can be found on the carts.ca.gov website.
The form mentions the Health & Safety Code 50897.3(e)(2) which mentions that as of February 23, 2021, if a landlord is seeking possession of their rental property through an eviction due to tenant’s failure to pay rent, or any other financial obligation under the rental agreement, the court can’t award the landlord judgment unless the landlord verifies the following items, under penalty of perjury:
- The landlord has not yet received rental assistance for the amount of rent owed stated on the eviction matter.
- The landlord has not received rental assistance or financial compensation for rent owed after the date of the notice stated in the eviction matter.
- The landlord does not have pending applications for rental assistance for the amount of rent owed stated on the eviction matter.
- The landlord does not have pending applications for rental assistance or financial compensation for rent owed after the date of the notice stated in the eviction matter.
At this time, we don’t know if this form will create additional setbacks in an already lengthy eviction process due to the COVID-19 pandemic and SB-91 still in full effect.
